These Terms of Service ("Terms") govern your access to and use of the website at atravelersjournal.net and related services (the "Service") operated by The J&J Shop LLC ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. Please read them carefully.
By using A Traveler's Journal, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Service.
A Traveler's Journal provides a digital companion service for our physical travel journal product. The Service allows you to:
You must sign in with a valid Google account to use our Service. You are responsible for maintaining the security of your Google account and for all activity that occurs under it. You must meet the minimum age required to have a Google account in your jurisdiction.
The digital Service is intended for use by purchasers of the A Traveler's Journal physical product. Each physical journal contains unique QR codes that are tied to that specific journal. By using the QR code feature, you confirm that you are the legitimate owner of a physical journal containing that QR code. QR codes are non-transferable and intended for use only by the original purchaser of the journal in which they appear.
Purchases of the physical journal are made through Amazon and are subject to Amazon's terms of sale, return policy, and shipping policies. We are not responsible for issues related to order fulfillment, shipping, or refunds for physical product purchases — please contact Amazon customer service for assistance with those matters.
Our Service creates and manages albums in your Google Photos account. By using this feature, you authorize us to create albums on your behalf. You retain full ownership and control of all photos and albums in your Google account. We do not store your photos on our servers. Your use of Google Photos is also subject to Google's own terms of service and privacy policy.
Access to the digital Service is provided at no additional cost to purchasers of the physical journal. The digital Service has no separate purchase price and is not independently refundable. Refunds for the physical journal itself are governed exclusively by Amazon's return policy. We are under no obligation to provide refunds, credits, or compensation in connection with the digital Service, including in the event of service interruptions, feature changes, or discontinuation of the Service.
You retain all ownership rights to the content you submit to the Service, including trip names, dates, notes, and any other information you provide ("Your Content"). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, process, and transmit Your Content solely for the purpose of operating and providing the Service to you. This license ends when you delete Your Content or your account, except to the extent we are required to retain backups for a limited period as described in our Privacy Policy.

The A Traveler's Journal name, logo, website design, physical product design, and all related content are owned by us. You may not use, copy, reproduce, or create derivative works from any of these without our written permission. Your personal content, including photos and journal entries, remains your own property.
If you believe that content accessible through our Service infringes your copyright, please contact us at the email below with a description of the allegedly infringing material, the location where it appears, and your contact information. We will respond to valid notices in accordance with applicable law.
We are continuously improving the Service and reserve the right to add, modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We may also discontinue the Service entirely with reasonable advance notice to active users where practicable. In the event the digital Service is discontinued, your physical journal remains fully usable as a paper travel journal, and any photo albums previously created in your Google Photos account will remain in your Google account and unaffected by the discontinuation of our Service.
Our Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any loss of data stored in third-party services such as Google Photos.
To the fullest extent permitted by law, A Traveler's Journal and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including any loss of data, photos, or revenue, even if we have been advised of the possibility of such damages.
Our total cumulative liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
You agree to indemnify, defend, and hold harmless A Traveler's Journal and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of the Service, or your violation of any third-party rights.
We shall not be liable for any failure or delay in performance under these Terms resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or power outages, or failures or disruptions of third-party services such as Google, Vercel, Supabase, or Resend.
Our Service integrates with Google, Google Photos, and other third-party services. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services.
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may stop using the Service at any time and revoke Google account access via your Google account settings. Upon termination, your account data will be handled in accordance with our Privacy Policy.
We may update these Terms of Service from time to time. We will post the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
Governing law. These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws principles.
Informal resolution first. Before filing any formal claim, you agree to first contact us at thejandjcompany.shop@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute by contacting you via email. If a dispute is not resolved within 60 days of submission, you or we may bring a formal proceeding.
Binding arbitration. Except for the exceptions below, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Connecticut or, at your election, in the county where you reside, or by telephone or video conference. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Exceptions to arbitration. Either party may bring an individual action in small claims court for disputes within the scope of that court's jurisdiction. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Class action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration section shall be null and void, but the remaining provisions of these Terms shall remain in full force.
Right to opt out. You may opt out of this arbitration agreement by sending written notice to thejandjcompany.shop@gmail.com within 30 days of first accepting these Terms. Your notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.
Court jurisdiction for excluded claims. For any disputes not subject to arbitration under this section, you and we agree that the state and federal courts located in Connecticut shall have exclusive jurisdiction, and you consent to the personal jurisdiction of those courts.
We may assign or transfer these Terms, in whole or in part, to any successor entity, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, or to a corporate entity formed to operate the Service. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section is void.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and A Traveler's Journal regarding the Service and supersede any prior agreements.
